نوازل ابن الفكون لابن الفكون القسنطيني المالكي : - دراسة وتحقيق - من كتاب النكاح إلى كتاب الغصب

Abstract

تسلّط هذه الرّسالة الضّوء على مخطوط من مخطوطات فقه النّوازل لعلَم من أعلام الجزائر، ألا وهو محمد بن عبد الكريم الفكّون المالكي القسنطيني المتوفّى سنة( 1114هـ)، وتمّ تناول الموضوع في قسمين: قسم الدّراسة، وقسم التّحقيق. أمّا قسم الدّراسة فقد اشتمل على دراسة المؤَلِّف( الكاتب)، ودراسة المؤلَّف( الكتاب)، أمّا بالنسبة لقسم التّحقيق فعملي في هذا القسم منحصر في جزء من هذا المخطوط؛ وهو من كتاب الأَحْباس إلى أخر الكتاب هذا إجمالا، أمّا على وجه التفصيل فهو يبدأ من بعض مسائل الأحباس، ثمّ مسائل القضاء، والشهادات، والمواريث، والزّنا، والسّرقة، ثمّ كتاب الجامع، وكان العمل في هذا القسم مُنصبا على إخراج الكتاب كما أراده مؤَلِّفه، مُتَبِعا في ذلك قواعد تحقيق النّصوص؛ من كتابته وفق قواعد الكتابة الحديثة، وعزو النّقولات إلى مظانّها، ووضع علامات التّرقيم، وتقسيم النّص إلى فقرات، ووضع عناوين فرعية...الخ. وذيّلت الكتاب بخاتمة أدرجت فيها أهمّ النتائح الـمُتوصَّل إليها في البحث This dissertation sheds light on a manuscript of Fiqh al-Nawazil by the distinguished Algerian scholar Muhammad ibn Abd al-Karim al-Fakkoun al-Maliki al-Qusanṭini (d. 1114 AH). The study is divided into two main sections: the study section and the critical edition section.

The study section examines both the author and the manuscript itself, while the critical edition focuses on a portion of the manuscript—from the chapter on al-Ahbās to the end of the book. Specifically, it covers topics such as al-Ahbās, judiciary, testimonies, inheritance, adultery, theft, and the final chapter al-Jāmiʿ. This section was devoted to presenting the text as intended by its author, following established principles of textual verification, including modern transcription, proper attribution of sources, punctuation, paragraph division, and the addition of subheadings.

The dissertation concludes with a summary of the main findings derived from the research.
