| dcterms.abstract | تتناول الرسالة دراسة دور مؤسسة الحسبة الإسلامية في الرقابة على النشاط الاقتصادي ومكافحة الفساد، مع مقارنتها بأجهزة الرقابة الحديثة في الجزائر، خاصة الهيئة الوطنية للوقاية من الفساد ومكافحته. وتهدف إلى بيان مفهوم الحسبة وأسسها الشرعية والتاريخية، وتشخيص ظاهرة الفساد الاقتصادي وأسبابه وآثاره، مع إبراز مظاهره المختلفة. وتخلص الدراسة إلى أن الحسبة تمثل نموذجًا رقابيًا متكاملًا بوسائل وقائية وعلاجية فعّالة، وأن تفعيل آلياتها يمكن أن يسهم في الحد من الفساد الاقتصادي في الجزائر رغم محدودية فعالية الأجهزة الرقابية المعاصرة. The dissertation examines the role of the Islamic institution of Hisba in combating economic corruption, compared with modern oversight bodies in Algeria. It aims to establish the theoretical and historical foundations of Hisba, analyze the phenomenon of economic corruption, its causes and effects, and evaluate the effectiveness of the National Body for Prevention and Fight against Corruption. The study shows that while contemporary oversight bodies suffer from limited effectiveness, the Hisba institution offers comprehensive preventive, corrective, and punitive mechanisms. It concludes that activating the Hisba model could contribute significantly to reducing economic corruption in Algeria. | - |
