التأمين في الفقه الإسلامي

Abstract

تتناول رسالة، دراسة فقهية تحليليّة لأحد أبرز المستجدات الاقتصادية والمعاملاتية في العصر الحديث وهو نظام التأمين بشتى أنواعه. وتتمحور مشكلة الدراسة حول تحديد الموقف الشرعي الدقيق من عقود التأمين التجاري والتعاوني، وتفكيك الإشكالات الفقهية المرتبطة بها مثل الغرر، القمار، والربا، والتي أدت إلى تباين واختلاف آراء الفقهاء المعاصرين بين التحريم والإباحة؛ حيث تسعى الرسالة إلى تأصيل هذه المعاملة المستحدثة وموازنتها بمقاصد الشريعة الإسلامية القائمة على جلب المصالح ودرء المفاسد، مع تقديم بدائل شرعية منضبطة تنظم الحماية المالية للمجتمع وتواكب الأنشطة الاقتصادية والاجتماعية المعاصرة. The thesis presents an analytical jurisprudential study of one of the most prominent economic and transactional developments in the modern era, namely the insurance system in its various forms. The core problem of the study revolves around determining the precise Islamic legal stance on commercial and cooperative insurance contracts, and dismantling the associated jurisprudential dilemmas—such as uncertainty (Gharar), gambling (Qimar), and usury (Riba)—which have led to divergent and conflicting opinions among contemporary jurists between prohibition and permissibility. Accordingly, the thesis seeks to ground this novel transaction in Islamic jurisprudence and balance it with the higher objectives of Sharia (Maqasid al-Shari'ah), which are based on bringing about public benefits and warding off harms, while providing disciplined Sharia-compliant alternatives that regulate financial protection for society and keep pace with contemporary economic and social activities.
