فقه البخاري في الديات من خلال تراجمه

Abstract

تتناول رسالة الماجستير، دراسة حديثية وفقهية استقرائية لمنهج الإمام البخاري الدقيق في استنباط الأحكام التشريعية المتعلقة بالجنايات والديات من خلال عناوين أبوابه (تراجمه) في كتاب الديات من صحيحه. وتتمحور مشكلة الدراسة حول تفكيك العلاقة الجدلية والارتباط الوثيق بين العناوين التي صاغها البخاري والأحاديث التي أوردها تحتها، ورصد كيفيات توجيهه للمسائل الفقهية الخلافية (كالعواقل، ومقادير الديات، وديات الأعضاء) عبر تلك التراجم؛ حيث تسعى الرسالة إلى إبراز عبقرية الإمام البخاري الأصولية والفقهية، والكشف عن معالم مدرسة فقه الحديث لديه، موازنةً بين آراء المحدثين والفقهاء لتقديم فهم أعمق للمقاصد الجنائية في السنة النبوية الشريفة The master's thesis presents an inductive hadith and jurisprudential study of Imam al-Bukhari’s precise methodology in deducing legislative rulings related to felonies and blood money (Diyat) through his chapter headings (Tarajim) in the 'Book of Diyat' of his Sahih. The core problem of the study revolves around deconstructing the dialectical relationship and close correlation between the headings formulated by al-Bukhari and the hadiths he cited beneath them, while monitoring how he directed controversial jurisprudential issues (such as the solidarity groups/Awaqil, the amounts of blood money, and the blood money for bodily organs) through those headings. Accordingly, the thesis seeks to highlight Imam al-Bukhari’s fundamentalist (Usuli) and jurisprudential genius, and to uncover the features of his school of Fiqh al-Hadith (jurisprudence of hadith), balancing the opinions of traditionists (Muhaddithun) and jurists (Fuqaha) to provide a deeper understanding of the penal objectives within the noble Prophetic Sunnah.
