تأويل النصوص في الفقه الإسلامي

Abstract

تتناول رسالة الماجستير، دراسة أصولية وتطبيقية معمقة لواحد من أهم المناهج التشريعية لضبط فهم الخطاب الشرعي. وتتمحور مشكلة الدراسة حول رصد وفحص الأحكام والضوابط الأصولية التي تحكم عملية "التأويل"؛ أي صرف اللفظ عن معناه الظاهر إلى معنى آخر يحتمله لدليل اقترن به، وتتبع الشروط العلمية الشارحة التي وضعها فقهاء الأصول لمنع التأويلات الفاسدة أو البعيدة التي قد تؤدي إلى تحريف النصوص وتوليد أحكام مجافية لمقاصد الشريعة؛ حيث تسعى الرسالة إلى تقديم رؤية تأصيلية متوازنة تبرز مرونة الفقه الإسلامي وسعته في استيعاب النوازل، مع الحفاظ في الوقت ذاته على قدسية النص وثبات الأحكام وضبط مسار الاجتهاد الفقهي المعاصر The master's thesis presents an in-depth doctrinal (Usuli) and applied study of one of the most important legislative methodologies for regulating the understanding of Sharia discourse. The core problem of the study revolves around monitoring and examining the doctrinal regulations and principles that govern the process of 'Interpretation' (Ta'wil)—meaning, diverting a word from its apparent meaning to another plausible meaning due to an associated evidence. It traces the explanatory scholarly conditions established by jurists of jurisprudence to prevent corrupt or remote interpretations that might lead to distorting the texts and generating rulings incompatible with the objectives of Sharia (Maqasid al-Shariah). Accordingly, the thesis seeks to present a balanced, foundational vision that highlights the flexibility and capacity of Islamic jurisprudence in accommodating contemporary developments (Al-Nawazil), while simultaneously preserving the sanctity of the text, the stability of rulings, and regulating the path of contemporary jurisprudential reasoning (Ijtihad)..
