نفقة الأقارب و الزوجة بين الشريعة والقانون : بحث مقارن بين المذاهب الفقهية وقانون الأسرة الجزائرية

Abstract

تتناول رسالة الماجستير، دراسة فقهية وقانونية مقارنة تسلط الضوء على أحد أبرز النظم المالية والاجتماعية الضامنة لاستقرار الأسرة وتكافلها. وتتمحور مشكلة الدراسة حول رصد وفحص أوجه الالتقاء والافتراق البنيوي والتشريعي بين الأحكام المقررة في المذاهب الفقهية الإسلامية والنصوص المقابلة لها في قانون الأسرة الجزائري، متتبعةً شروط استحقاق النفقة، وموجباتها، ومعايير تقديرها، وآليات إسقاطها لكل من الزوجة والأقارب؛ حيث تسعى الرسالة إلى بيان شمولية وعدالة التشريع الإسلامي ومرونته في تنظيم الرعاية المالية، وإبراز مدى توفيق المشرع الجزائري في استيعاب الأحكام الفقهية وتطبيقها بما يتلاءم مع المستجدات الاجتماعية المعاصرة، وتعميق آليات البحث المقارن في الدراسات القانونية والشرعية The master's thesis presents a comparative jurisprudential (Fiqhi) and legal study that sheds light on one of the most prominent financial and social systems safeguarding family stability and solidarity. The core problem of the study revolves around monitoring and examining the structural and legislative points of convergence and divergence between the rulings established in Islamic jurisprudential schools and their corresponding texts in the Algerian Family Code. It traces the conditions of entitlement to maintenance (* Nafaqah*), its obligations, criteria of assessment, and mechanisms of forfeiture for both the wife and relatives. Accordingly, the thesis seeks to demonstrate the comprehensiveness, justice, and flexibility of Islamic legislation in organizing financial care, highlighting the extent of the Algerian legislator's success in absorbing and applying jurisprudential rulings in a manner compatible with contemporary social developments, and deepening the research mechanisms of comparative research in legal and Sharia studies.
