dc.description.abstractتتمحور هذه الدراسة حول أحكام المعاملات المالية ونظرية العقد في الفقه الإسلامي—مع التركيز على تفريعات المدرسة الحنفية—حيث تسلّط الضوء على الضوابط الشرعية الكفيلة بحفظ استقرار العقود ومنع النزاعات. وتناقش الأطروحة بشكل تفصيلي أثر "الجهالة الفاحشة" في إفساد عقود البيع، وتُفكك أنواعها الأربعة المحظورة: جهالة محل العقد (من حيث الجنس أو النوع أو القدر)، وجهالة الثمن، وجهالة الأجل، وجهالة وسائل التوثيق. كما تمتد الدراسة لتأصيل بنود السلامة التعاقدية الأخرى؛ ومنها خلوّ العقد من الإكراه وأثره في جعل العقد فاسداً أو موقوفاً عند جمهور الحنفية، وخلوّه من التوقيت لتعارضه مع غاية البيع الأساسية وهي تمليك العين مؤبداً، فضلاً عن شروط السلامة من الغرر (مفرّقةً بين غرر الوصف وغرر الوجود والعدم كبيع نتاج النتاج)، وخلوّ المعاملة من الضرر المانع من تسليم المبيع أو الملحق أذى بالمتعاقدين؛ معتمدةً في ذلك على المنهج التحليلي المقارن بين الآراء الأصولية لجهابذة المذهب كالكاساني وابن الهمام. This study centers on the rulings of financial transactions and contract theory in Islamic jurisprudence—with a specific focus on the sub-branches of the Hanafi school—shedding light on the Sharia regulations capable of preserving the stability of contracts and preventing disputes. The thesis discusses in detail the impact of 'gross ignorance' (al-jahalah al-fahishah) in invalidating contracts of sale, deconstructing its four prohibited types: ignorance regarding the subject matter of the contract (in terms of genus, type, or quantity), ignorance of the price, ignorance of the time limit, and ignorance of the means of documentation. Furthermore, the study extends to establish other clauses of contractual validity; including the contract's freedom from coercion (ikrah) and its effect in rendering the contract irregular (fasid) or suspended (mawquf) according to the majority of Hanafi jurists, and its freedom from temporary timing (al-tawqit) as it conflicts with the primary purpose of sale, which is the permanent transfer of ownership of the property. Additionally, it addresses the conditions of safety from uncertainty (gharar) (distinguishing between uncertainty of description and uncertainty of existence/non-existence, such as selling the offspring of an unborn animal) and ensuring the transaction is free from harm (darar) that prevents the delivery of the sold item or inflicts injury upon the contracting parties; relying in this analysis on the comparative analytical method between the fundamental views of the school's eminent scholars, such as Al-Kasani and Ibn al-Humam.-
