منهج الاجتهاد عند عمر بن الخطاب - رضي الله عنه - وأثره في التشريع الإسلامي

Abstract

تتناول هذه الرسالة الأكاديمية المعنونة بـ "منهج الاجتهاد عند عمر بن الخطاب رضي الله عنه وأثره في التشريع الإسلامي"، دراسة تحليليّة معمّقة للأصول والقواعد التشريعيّة التي استند إليها الفاروق في استنباط الأحكام الفقهية ومواجهة النوازل المستجدة في عصره نتيجة اتساع الفتوحات. تبرز أهمية الدراسة في كشفها عن مرونة الفقه العمري وقدرته على مراعاة مصالح الناس ودفع المفاسد دون الخروج عن مقاصد الشريعة، إلى جانب تفنيد الادعاءات المعاصرة التي تزعم مجانبة بعض اجتهاداته للنصوص الصريحة. وقد قُسّم البحث إلى أربعة فصول رئيسة تتبعت عوامل تكوين شخصيته العلمية، واجتهاداته المستندة إلى النص، وتلك المبنية على الرأي بمختلف فروعه كالمصلحة والقياس، لتخلص الرسالة إلى إبراز الخصائص الأصولية والفقهية المتميّزة لمنهجه وكيفية الإفادة منها في معالجة مشكلات الحياة المعاصرة. This academic thesis, entitled "The Method of Ijtihad (Independent Reasoning) of Omar ibn al-Khattab (May Allah Be Pleased with Him) and Its Impact on Islamic Jurisprudence," presents an in-depth analytical study of the principles and legislative rules upon which Al-Faruq relied to derive jurisprudential rulings and address emerging issues (Nawazil) during his era, driven by the expansion of Islamic conquests. The significance of this study lies in revealing the flexibility of Omari jurisprudence and its capacity to serve public interests and prevent harms without departing from the higher objectives (Maqasid) of Sharia. Furthermore, it refutes contemporary claims alleging that some of his reasoning diverged from explicit religious texts. The research is structured into four main chapters that trace the factors shaping his intellectual personality, his text-based reasoning, and his opinion-based reasoning (Ra'y) through its various branches, such as public interest (Maslahah) and analogical deduction (Qiyas). Ultimately, the thesis highlights the distinct fundamental and jurisprudential characteristics of his methodology and explores how they can be utilized to address the challenges of contemporary life.
