| Authors: | تناولت هذه الدراسة موضوع: (( اختيارات الإمام الداودي من خلال كتابه "الأموال " جمعا ودراسة )) هادفة إلى إبراز الجهود التي بذلها الداودي في خدمة الفقه الإسلامي عموما والفقه المالكي على وجه الخصوص، والاطلاع على العقلية الفقهية التي يمتلكها ، والتعرف على تراثه العلمي.
وقد تعرضت الدراسة لحياة الداودي وذكرت مصنفاته في شتى العلوم الشرعية، ثم تناولت كتابه " الأموال" بالدراسة كعينة للوقوف على منهجه في عرض المسائل الفقهية ومناقشتها واستنباط الأحكام من دراستها، وبينت اهتمام العلماء بآرائه وأقواله، حيث تناقلوها في دواوينهم.
وفي الفصل الأول أظهرت اختيارات الداودي التي تتعلق بالغنائم، وفي الفصل الثاني تناولت اختيارات الداودي من خلال الأموال المكتسبة من طرق غير شرعية، وفي الفصل الأخير بينت اختيارات الدودي في مسائل متفرقة من أبواب مختلفة.
ومن خلال هذه الفصول الثلاثة أظهرت الدراسة بعض الجوانب التي بينت دور الداودي في تنقيح الفروع الفقهية المالكية والاستدلال لأحكامها مع مقارنتها بمثيلاتها في المذاهب الفقهية الأخرى.
وانتهت الدراسة إلى نتائج مهمة أبرزها: أن الإمام الداودي علم من أعلام المالكية ارتقى مرتبة عالية بين علمائها، وكانت له القدرة على التصرف في المذهب بالترجيح والتعليل والاجتهاد والتمحيص في منقولاته.
وقد أوصت الدراسة بتوصيات أهمها: زيادة الاهتمام بإحياء التراث الفقهي الإسلامي عامة والفقهي المالكي خاصة؛ للاستفادة من جهود علمائنا الأسلاف .
This study addressed the issue: ((Imam Daoudi choices through his "money" crowd and study))
Aimed to highlight the efforts made by Daoudi in Islamic jurisprudence in general and al-Maliki Fiqh service in particular, and see the jurisprudential mental possessed, and to identify the scientific heritage
The study took life Daoudi said his works in various forensic science, then turned his book "Money," the study sample to determine the approach in the presentation of doctrinal questions, discuss and develop provisions of the study, and showed interest in scientific views and words, which ,Where he traded in an their books.
In the first chapter Daoudi choices concerning booty shown, in the second chapter Daoudi choices addressed through money earned from illegal ways, and in the last chapter showed worm choices in different issues from different doors.
Through these three chapters study showed some aspects that showed Daoudi role in the revision of the branches of jurisprudence Maalikis and reasoning of its provisions compared with those in other schools of fiqh.
The study concluded that significant results clearest: Imam Daoudi aware of Flags Maalikis elevated rank high among scientists, and has had the ability to act in doctrine Batorgih reasoning and diligence and revision in movable.
The study recommended the recommendations, including: increased interest in reviving heritage Islamic Fiqh General and idiosyncratic Maliki private; to benefit from the efforts of our scientists ancestor.
