الحمد لله و الصلاة و السلام على رسول الله و على آله و صحبه و من والاه و بعد: فهذا ملخص للرسالة المقدمة لنيل درجة "الماجستير" في الفقه الإسلامي بعنوان: "حقوق الله و حقوق العباد و أثرهما فيما يثبت فيه الضمان – الأحوال الشخصية أنموذجا". و قد اشتملت هذه الرسالة على المقدمة و ثلاثة فصول و الخاتمة. أما المقدمة ففيها: بيان أهمية الموضوع. إشكالية البحث. و أسباب اختياره. و الهدف من البحث. و الدراسات السابقة. و منهج البحث. و الخطة العامة للبحث. و اشتمل الفصل الأول على: أربعة مباحث: المبحث الأول: تعريف الحــــــقــــــوق، و فيه مطلبين،المبحث الثاني: بيان مصدر الحقوق وأركانها، و فيه مطلبين أيضا، المبحث الثالث: تقسيمات الحقوق، و مكانة حقوق الله وحقوق العباد فيها، و فيه مطلبين، المبحث الرابع: تعريف الضمان، وبيان مشروعيته،و أسبابه، و مقاصده، و فيه ثلاثة فصول. و اشتمل الفصل الثاني: بيان حقائق و مفاهيم البحث، على: ثلاثة مباحث: المبحث الأول : القواعد الفقهية المتعلقة بحقوق الله و حقوق العباد، و فيه ثلاثة مطالب، المبحث الثاني : قواعد الترجيح بين حقوق الله و حقوق العباد، و فيه ثلاثة مطالب أيضا، و المبحث الثالث : القواعد الفقهية المتعلقة بالضمان فيما يخص حقوق الله و حقوق العباد، و فيه مطلبين. و اشتمل الفصل الثالث: أثر الضمان في مسائل الأحوال الشخصية و بيان تعلقه بحقوق الله و حقوق العباد، و فيه أربعة مباحث: المبحث الأول :الضمان بسبب العدول عن الخطبة، و بيان تعلقه بحقوق الله و حقوق العباد، و فيه مطلبين،المبحث الثاني : الضمان بسبب ما يطرأ على المهر من طوارئ، و بيان تعلقه بحقوق الله و حقوق العباد، و فيه مطلبين، المبحث الثالث: الضمان فيما يخص النفقة و بيان تعلقه بحقوق الله و حقوق العباد، و فيه مطلبين، المبحث الرابع : ضمان بدل الخلع، و بيان تعلقه بحقوق الله و حقوق العباد، و فيه مطلبين. ثم الخاتمة التي اشتملت على أهم النتائج و التوصيات . و صلى الله و سلم و بارك على نبينا محمد و على آله و أصحابه الطيبين و من تبعهم بإحسان إلى يوم الدين.

The message summary Praise be to God and prayer and peace be upon the Messenger of God and his family and companions and allies and from and after: This is a summary of the message submitted for the degree of "Master" in Islamic jurisprudence entitled: "The rights of God and rights of other people and their impact in proving the security - a model of personal status."And this message has been included on the front and three chapters and the conclusion.As provided wherein: Statement importance of the topic. Find problematic.And the reasons for his choice.The aim of the research. And previous studies.And research methodology.And the general plan of research.And it included the first chapter: four topics: First topic: Definition of rights, and the two demands, second topic: the statement of the source of rights and pillars, and the two demands also, third topic: the divisions of rights, and the status of the rights of God and the rights of the subjects in which, and the two demands, Section IV: definition of security, and the statement of its legitimacy, and its causes, and its purposes, and the three chapters.And it included Chapter II: Statement of Facts and concepts of research, on: three sections: First topic: the rules of jurisprudence concerning the rights of God and rights of other people, and the three demands, second topic: the rules of the weighting between the rights of God and rights of other people, and also the demands of the three, and the third topic: the rules of jurisprudence relating to security with respect to the rights of God and rights of other people , and the two demands.And the third quarter included: the impact of security in personal status and rights statement attachment to God and human subjects issues, and the four topics:First topic: security due to reverse the sermon, and the statement of attachment to the rights of God and rights of other people, and the two demands, second topic: security because of what occurs to the dowry of emergency, and release attachment to the rights of God and rights of other people, and the two demands, the third section: security with regard to alimony and a statement attached rights of God and rights of other people, and the two demands, Section IV: ensure dislocation allowance, and a statement attachment to the rights of God and rights of other people, and the two demands. Conclusion which then included the most important findings and recommendations. And peace and blessings of God and bless our Prophet Muhammad and his companions and of good and followed them in truth until the Day of Judgment.
