دور المنظمات الدولية في تحقيق السلم والأمن الدوليين : دراسة مقارنة بين الفقه الاسلامي والقانون الدولي

تعتبر المنظمات الدولية آلية من آليات تحقيق السلم والأمن الدوليين، وقد اعتمدت لتحقيق هدفها هذا على مجموعة من المناهج الذي أنشئت من أجله، وكان أولها تسوية المنازعات بالطرق السلمية، واعتمدت على المفاوضة، والوساطة والتحقيق، وغيرها... ثم مع تطور العلاقات الدولية ظهر منهج الأمن الجماعي، الذي يعتمد على الوسائل غير العسكرية، بالإضافة إلى استعمال الوسائل العسكرية في حال تهديد السلم والأمن الدوليين. ومنهج نزع السلاح، ومنهج تصفية الاستعمار. ثم منهج التعاون الاقتصادي والاجتماعي والثقافي. ومن وجهة النظر الشرعية يظهر أن الإسلام قد سعى بل وجد لأجل تحقيق السلام والأمن، بل إن الإسلام هو السلام، وقد سعت الدولة الإسلامية لتحقيقهما بشتى الوسائل، لأن تحقيق السلم والأمن في العالم مصلحة مقصودة بذاتها، بل هي مقصد من مقاصد الشارع لما توفره من حفظ النفس، والمال، والنسل. وتتحقق هذه المصلحة بوسائل حددها فقهاء الشريعة الإسلامية، منها: تقسيم المجتمع الدولي إلى قسمين أو ثلاثة، وتأكيد أن أصل العلاقات الدولية السلم وليس الحرب، وعقد الدولة الإسلامية المعاهدات والأحلاف مع غيرها في سبيل توفير سلم وأمن دوليين، وما تشريع الجهاد في الحقيقة إلا لحماية السلم والأمن الدوليين، بردع المعتدي، والحفاظ على الاستقرار الدولي. لهذا فالإسلام لا يمنع من الدخول في منظمات دولية تخدم الإنسانية جمعاء، حتى ولو كان بعض أعضاءها من غير المسلمين، وهو يدعو إلى المبادئ الإسلامية من الوفاء بالعدل، والأمانة، والصدق. وبالرغم أنه للمنظمات دور فعال، تترأسها الأمم المتحدة التي أخذت على عاتقها حماية السلم والأمن العالميين، واستطاعت حماية البشرية من ويلات حرب مدمرة ثالثة، إلا أنها لا ترقى إلى ما هو مطلوب منها، فالأمم المتحدة تتبع سياسة الكيل بمكيالين، وحق الفيتو، وتحكم الدول الكبرى في قراراتها، وافتقار قراراتها إلى إلزام فعلي، بالإضافة إلى سيادة الدولة، ومبدأ عدم التدخل في المسائل الداخلية للدولة التي تعيق عملها، وغيرها...وتعتبر قضية الشرق الأوسط من أبرز الأمثلة على فشل الأمم المتحدة في تحقيق السلم والأمن الدوليين. مما يتطلب إصلاحا فعليا الأمم المتحدة حتى تتمكن من الاستمرار في ظل التطورات الدولية.

أما المنظمات الإقليمية كجامعة الدول العربية، ومنظمة التعاون الإسلامي فتعيش ما تعيشه الدول العربية والإسلامية من الركود، والانقسام، لذلك يجب تفعيل دورها بتجاوز أسباب تخلفها. ويمكن تفعيل الدور الذي تقوم به المنظمات الدولية الإقليمية بتوفير الظروف الملائمة لعملها، وبالتعاون مع الأمم المتحدة لكي تتمكن من أداء دورها في المجتمع الدولي. Et même que ces organismes ont un rôle primordiale, avec le commandement des nations unies qui a pris la responsabilité de protéger la paix et la sécurité internationale, et elle a pu protéger l’humanité d’une troisième guerre mondiale, mais son rôle n’est pas tout à fait parfait, vu que les nations unies suivent une politique double standard et le droit de VETO, qui permet aux grands pays de contrôler ses décisions, même que ses décisions n’ont pas une réactions, ainsi que la souveraineté de l’état, et le principe de non-ingérence dans les affaires intérieurs des pays gène son rôle…. Et l’affaire du moyen orient est la grande preuve de son échec dans son rôle, et cela demandera une réparation des nations unies pour qu’elles puissent continuer vu les transformations internationales. Bien que les organisations régionales tel que l’université des pays arabes, et l’organisation de la coopération islamique vies ce que les pays arabes et islamiques vivent tel que la récession et la division, il faut activer son rôle en réglant la raison de son échec. Et même peut-on activer le rôle des organismes internationaux régionales en offriront les conditions appropriées pour leur travail, et avec l’aide des nations unies pour qu’elles puissent faire son rôle dans la communauté internationale.
