dc.description.abstractتناولت هذه الدراسة مبدأين هامين من المبادئ المنظمة للحرب و النزاعات المسلحة وذلك في دراسة مقارنة بين الفقه الاسلامي و القانون الدولي الانساني. لقد تطرقت في الفصل الأول الى ماهية الحرب ومشروعيتها و أنواع النزاعات المسلحة و خلصت الى أن الحرب تبقى محظورة في الشريعة الاسلامية كما في القانون الدولي الانساني إلا لضرورة تجيزها و تقننـها في الإطار الذي شرعت من أجله دون تجاوز ذلك . ولقد تطرقت في الفصل الثاني الى مبدا التمييز بين المقاتلين و غير المقاتلين و بين الأعيان المدنية و الأهداف العسكرية و الحمايــة المقررة لضحايا النزاعات المسلحة و ما ينجم عن ذلك من حظر أو تقييد لوسائل و أساليب القتال و خلصت الى التقاء القانون الدولي الانساني مع الفقه الاسلامي في كثير من المسائل النبيلة كمنع قتل غير المقاتلين و تجنب استهدافهم و استهداف ممتلكاتهم الا أن الفقه الاسلامي أكثر ضمانا من الناحية العملية من القانون الدولي الانساني نظرا لطابعه التعبدي. ولقد تطرقت في الفصل الثالث إلى مبدأ الضرورة العسكرية وضوابطها في التعامل مع الأشخاص و الأعيان و المسؤولية الدولية المترتبة عن انتهاك مبادئ الحرب و خلصت الى أن الضرورة العسكرية تشكل قيدا على سير العمليات العسكرية و لا يحق لأطراف النزاع الخروج على القواعد المنظمة لها الا بتوفر ضرورة حربية تجيز ذلك في الحدود التي رسمت لها و هذا ما اقره الفقه الاسلامي و القانون الدولي الانساني معا . This study addresses two fundamental principles governing warfare and armed conflicts through a comparative analysis of Islamic jurisprudence (Fiqh) and International Humanitarian Law (IHL). The first chapter explores the nature and legitimacy of war, alongside the classification of armed conflicts. It concludes that warfare remains prohibited under both Islamic law and IHL, except in cases of absolute necessity that justify and regulate it strictly within its prescribed framework without transgression. The second chapter examines the principle of distinction between combatants and non-combatants, as well as between civilian objects and military objectives, in addition to the protections afforded to victims of armed conflicts. This includes the resulting prohibitions or restrictions placed on the means and methods of warfare. The findings reveal a significant alignment between IHL and Islamic jurisprudence across numerous noble advancements—such as prohibiting the killing or targeting of non-combatants and their property. However, the study notes that Islamic jurisprudence offers greater practical guarantees than IHL due to its inherently devotional and religious nature (Ta'abbudi). The third chapter investigates the principle of military necessity and its governing criteria regarding the treatment of persons and objects, alongside the international responsibility arising from violations of the laws of war. It concludes that military necessity serves as a constraint on the conduct of military operations. Parties to a conflict are not permitted to deviate from these regulatory rules unless an absolute military necessity arises, and even then, strictly within the boundaries delineated for it. This position is mutually reinforced and upheld by both Islamic jurisprudence and International Humanitarian Law.-
