الاختيارات الفقهية من خلال كتاب " الزاهي " : جمعا ودراسة " فقه الأسرة أنموذجا "

باسم الله و الصلاة و السلام على رسول الله ﷺ و على آله و صحبه و من والاه، أما بعد: قمت في هذه الرسالة بدراسة بعض المسائل الفقهية المتعلقة بفقه الأسرة، و التي أظهر ابن شعبان فيها اختياره من خلال كتابه "الزاهي في أصول السنة" مع مقارنتها بأقوال المالكية، و قد قسمت هذه الرسالة إلى خمسة فصول، كل فصل قسمته إلى مباحث، و تفصيل هذه الفصول كالتالي: الفصل الأول: النكاح و قمت فيه بدراسة بعض المسائل المتعلقة بأحكام النكاح. الفصل الثاني: الطلاق و تكلمت فيه عن بعض المسائل المتعلقة بالطلاق. الفصل الثالث: الظهار و قمت فيه بدراسة بعص المسائل المتعلقة بأحكام الظهار. الفصل الثالث: اللعان و قمت فيه بدراسة بعض المسائل المتعلقة بأحكام اللعان. الفصل الخامس: العدة و تطرقت فيه إلى بعض المسائل المتعلقة بأحكام العدة. و ختمت الرسالة بما توصلت إليه من النتائج مع بعض التوصيات. و الحمد لله رب العالمين. Bismillah wa el hamdoulillah wa salat wa salam âla rasoulillah wa âla alihi wa sahbihi wa man walah. Dans cette étude, je me suis intéressé aux problèmes majeures de jurisprudence, auxquelles Ibn Chaâbane a montré son choix concernant le loi islamique de la famille à travers son livre « ALZAHI FI OUSSOUL ALSOUNNAH ». Pour cela j’ai composé mon étude comme suite : Première partie : Introduction Dans cette partie j’ai parlé brièvement des aspects de la vie d’Ibn Chaâbane et de la méthode utilisée pour la déduction de ces choix dans ce livre. Deuxième partie : dans laquelle j’ai traité cinq sections de plusieurs choix d’Ibn Chaâbane A/ Première section « le mariage » : je parle de certains aspects et choix concernant le mariage. B/ Deuxième section « le divorce » : je parle des lois qui régissent le divorce en islam. C/ Troisième section « Dhihar » : il parle de certains sujets qui concernent Dhihar. D/ Quatrième section « Aliâne » : j’ai évoqué le sujets qui concernent Aliâne. E/ Cinquième section « Alîdda » : j’ai évoqué dans cette section les sujets qui concernent Alîdda et ses lois. Et j’ai conclu cette étude par les résultats trouvés et certaines recommandations.

In this study, I am interested in the major problems of jurisprudence, in which Ibn Chaâbane showed his choices regarding the Islamic law of the family through his book “Al Zahi Fi Ousoul Alsounah”. My studies are consisted of the following: Part I: Introduction I spoke briefly about Ibn Chaâbane’s aspects of life and the method used to deduce his choices. Part II: The main parts of this study are five: A / First part: The marriage I talked about some aspects of marriage. B / Second part: The divorce I talked about divorce governing laws that in Islam. C / Third part: I talked about some topics related to Zihhar. D / Fourth part; I mentioned the topics related to Aliaân. E / Fifth part: Idaa I mentioned subjects related to Idaa and its laws. I concluded this study with the results found and some recommendations.
