أسباب اختلاف الأصوليين في معاني اعتبار العلة صحة وفسادا : دراسة تحليلية نقدية

الحمد لله والصلاة والسلام على رسول الله وعلى آله وصحبه ومن والاه، أما بعد: تعد العلّة أهمّ ركن في القياس التي تناولها الأصوليّون في كتبهم،وممّا لاشك فيه أنّ دراسة الأسباب التي جعلت الأصوليين يختلفون في المعاني المعتبرة لصحة وفساد العلة لمن صميم تلك الأهميّة ، ولهذا اخترت أن أعنون مذكرتي لنيل شهادة الماجستير ب: " أسباب اختلاف الأصوليين في معاني اعتبار العلة صحّة وفسادا". إنّ هذا البحث ينطلق من إشكالية محدّدة تتمثل في سؤال مركزي ،هو : لماذا تضاربت آراء الأصوليين في تحديد المعاني المعتبرة في صحة العلة وفسادها ؟ بمعنى: ما هي الأسباب التي جعلت الأصوليين يختلفون في اعتبار العلة؟ وعليه فهل كل معنى اشترطه الأصوليون في اعتبار صحة أو فساد العلة يكون عند التحقيق صالحا لاعتبارها أو مفسدا لها حقيقة؟ وهل اختلافهم وجيه؟ وهل يمكن تضييق هوة هذا الخلاف بمعرفة الأسباب الحقيقية؟. ولقد اتبعت في هذا ابحث منهجين لبلوغ غايتي؛ المنهج الاستقرائي والمنهج التحليلي، فأما الاستقرائي فبمحاولة تتبع أطراف الموضوع في مظانّه من كتب الأصول لكي يتسنى لي الحصول على نظرة واسعة وشاملة على موضوع البحث، وجمع أكبر قدر من المعلومات عنه، وأما المنهج التحليلي ففي تحليل معطيات المؤلفات وآراء المؤلفين حول الموضوع، والتعليق عليها إذا اقتضى الأمر ذلك. ومن أجل الإجابة على الإشكالية المطروحة في مستهل هذا البحث، كان لزاما عليّ وضع خطة تفي بهذا الغرض، وتحيط بالموضوع من جميع أطرافه، تحتوي على فصل تمهيدي ، وفصلين، ضمّنت هذه الفصول مباحث تجلي غموضها وتفسر مبهمها. وقد تبع ذلك كله خاتمة استخلصت فيها أهم ما أفضى إليه البحث من نتائج. Therefore, I chose to mention my note of the Master's Degree as follows: "Reasons for the difference of fundamentalists in the meanings of Health and corruption ". This research is based on a specific problem, which is a central question: Why did fundamentalist views clash with regard to determining the meanings considered to be correct and corrupt? In other words, what are the reasons why the fundamentalists differ in considering the problem? Therefore, is every sense required by the fundamentalists to consider the validity or corruption of the bug when the investigation is valid to be considered or a real spoiler? Do they disagree? Is it possible to narrow this gap by knowing the real reasons? In this way I have followed two approaches to achieving my goal: the inductive approach and the analytical approach, either inductive by trying to trace the sides of the subject in the form of asset books so that I can get a broad and comprehensive look at the subject of the research and gather as much information as possible. Authors and opinions of the authors on the subject, and comment if necessary. In order to answer the problem presented at the beginning of this research, it was necessary to develop a plan that meets this purpose, and takes the subject from all parties, containing a preliminary chapter, and two chapters, these chapters ensured the disclosure of the ambiguity and explain the vagueness. This was followed by a conclusion in which the main findings of the research were concluded.

Louange à Dieu et prières et paix soient sur le Messager d'Allah et sa famille et ses compagnons et ceux qui le suivent, La raison en est que l'étude des raisons pour lesquelles les fondamentalistes ont différé dans les significations considérées pour la santé et la corruption de la cause de cette affaire est importante. Par conséquent, j'ai choisi de mentionner ma note du Master comme suit: Santé et corruption ". Cette recherche est basée sur un problème spécifique, qui est une question centrale: pourquoi les vues fondamentalistes se sont-elles heurtées à la détermination des significations considérées dans la validité et la corruption du problème? En d'autres termes, quelles sont les raisons pour lesquelles les fondamentalistes divergent dans la prise en compte du problème? Par conséquent, est-ce que tous les sens requis par les fondamentalistes doivent considérer la validité ou la corruption du bug au moment de l'enquête valable pour être considéré ou un vrai spoiler? Est-ce qu'ils sont en désaccord? Est-il possible de réduire cet écart en connaissant les vraies raisons? J'ai ainsi suivi deux approches pour atteindre mon but: l'approche inductive et l'approche analytique, soit inductive en essayant de tracer les côtés du sujet sous forme de livres d'actifs afin que je puisse avoir un regard large et complet sur l'objet de la recherche. Auteurs et opinions des auteurs sur le sujet, et commenter si nécessaire. Afin de répondre au problème présenté au début de cette recherche, il était nécessaire de développer un plan qui réponde à ce but et reprend le sujet de toutes les parties, contenant un chapitre préliminaire et deux chapitres, ces chapitres assurant la révélation de son ambiguïté et expliquant sa signification. Ceci a été suivi d'une conclusion dans laquelle les principales conclusions de la recherche ont été conclues.
