نوازل حقوق الأجير : دراسة فقهية مقارنة مع القانون الجزائري

Abstract

تتناول هذه الدراسة استخراج حقوق العمّال المستجدّة في القانون الجزائري وتحليلها ومقارنتها بأحكام الشريعة الإسلامية وأقوال الفقهاء، من خلال دراسة نوازل حقوق الأجير وتكييفها وتنزيل الأحكام الشرعية عليها. وقد عالجت حقوق الأجير في الأجرة والترقية والتكوين، والاستفادات أثناء العمل كالعطل والضمان الاجتماعي وظروف العمل، إضافة إلى حقه في المطالبة بحقوقه عبر العمل النقابي والإضراب. وخلصت الدراسة إلى نتائج تأصيلية تقوم على القواعد الكلية للفقه الإسلامي، وأخرى تفصيلية بيّنت الأحكام والضوابط الشرعية، مع تثمين ما وافق الشريعة من القوانين ونقد وتصحيح ما خالفها. This study examines contemporary workers’ rights derived from Algerian law through analysis and comparison with Islamic jurisprudence and the opinions of jurists. It addresses workers’ rights to wages, promotion, training, workplace benefits such as rest, leave, social security, and suitable working conditions, as well as their right to claim these rights through union activity and strikes. Given the central role of workers in society, the study highlights practical legal issues requiring sound Islamic rulings. It concludes by presenting both foundational jurisprudential principles and detailed legal rulings, affirming laws consistent with Sharia, critiquing those that contradict it, and proposing corrections where possible.
