منهج البحث في أصول الفقه المذهبي

Abstract

ما بُين في هذا البحث أن منهج البحث في أصول الفقه المذهبي لا يَختلف فيه في الجملة، بعض المذاهب عن بعض؛ ولهذا لم نخصّصهُ بمذهب معين؛ فأصول المذاهب الموروثة واحدة، وما يعرض فيها من خلاف قليل، وإن كان بعضهم أمثل من بعض، وعظم الخلاف مرده إلى تباين اصطلاحهم، وهو قد يكون في المذهب الواحد، ثم ليس وراء الحق بعد معرفته غاية. والاختلاف في هذا الأمر مرجعه إلى ما يرتبط بالفهم بمراتبه التي أشرنا إليها، سواء في معرفة مراد الله تعالى، أم في إقامة الدليل عليه. Abstract : What is illustrated in this research-paper is that: theresearch methodology in The Jurisprudence’s Roots Rituals does not differ in the total regarding the rites between each other; that is why we have not specified it with a particular rite, for the origin of The Rites is one and what is shown as difference between them is few; even though, some of them are more similar then others. The great difference is caused by diversity in their technical terms, that can exist in one Rite itself; then there is no truth to be known after it as a goal. The difference in this matter is referred to what is linked to the classes (degrees) of understanding that we have mentioned before, either in knowing the purpose of The Almighty Allah’s Legislation or the making of evidence on it.
