فقه الأقليات الدينية في المجتمع الإسلامي

Abstract

تهدف هذه الدراسة لتسليط الضوء على العلاقة التي سادت في المجتمع الإسلامي، بين المسلمين والأقليات غير المسلمة، فقد سجل التاريخ صفحات ناصعة من التعايش السلمي والتسامح الديني، ونبذ التعصب وتحقيق ما يصطلح على تسميته اليوم بالمواطنة، بخلاف ما يروج له بعض كتاب الغرب الذين يتبنون مشروع التخويف من الإسلام، أو ما يعرف بالإسلام فوبيا، مستدلين بفتاوى معاصرة شاذة . كما توضح هذه الدراسة النظرة الشرعية لغير المسلمين في المجتمع الإسلامي، وتستعرض بعض الأحكام الفقهية التي تبرز مدى تفوق التشريع الإسلامي في تحقيق مبادئ المساواة والتسامح والتعايش الراقي بين أفراد المجتمع الواحد. Abstract: This study has as main objective the focus on the relationship which dominated in the islamic society between the muslims and the non islamic minorities .There were peaceful coexitence,religious tolerance and realization of citizenship on the contrary of what the occidental writers promote as a project of islamophobia having as proofs contemparary fatwas abnormal. This study,also reveals the islamic outlouk for the non muslims in the islamic society and shows some islamic jurisprudence which puts in consideration the over superiority of the islamic legislation in the realization of the principles of equality,tolerance and co-existence betwen the members of the same society.
