القرائن وأثرها في تكوين إقتناع القاضي الجنائي

Abstract

تحتل القرائن أهمية بالغة في مجال الاثبات الجنائي من الناحية العلمية والعملية، لاسيما مع التطور العلمي الحديث في مجال ارتكاب الجرائم. ومما لاشك فيه أن القرائن تخضع لمطلق تقدير القاضي الجنائي، ولها دور جد فعال في تكوين اقتناعه الشخصي خاصة في ظل غياب أو عجز الأدلة المباشرة في أداء الدور المنوط بها. غير أن سلطة القاضي الجنائي في الاقتناع ليست مطلقة بل مقيدة بوجوب أن تكون هذه القرائن مشروعة، مطروحة للمناقشة، فضلا عن وجوب أن تكون مبنية على الجزم واليقين الجنائي لا الظن والترجيح، بالإضافة إلى وجوب تسبيب القاضي الجنائي حكمه عند اعتماده على القرائن كدليل اثبات. Abstract : Proofs have a significant importance in criminal evidence for its scientific and practical side regarding the scientific progress in terms of committing crimses. Without douth those proofs are taken by the criminal judge, and have an important role to from his perrsonal conviction. especially in absence or failure of direct proofs to do what is expected from it but this judge authority and power to get conviction and certainty is not totally free, but rather limited from one side to be legal, open to discussion and more to be based on sureness and certainty not douths and interpretations, further more it is a must for the judge to make it the cause as a basis to prove his conviction.
