إشكالية توريث الخُنثى المُشكل في قانون الأسرة الجزائري

Abstract

يعالج هذا المقال موضوع ميراث الخنثى المشكل وإشكالية توريثه في قانون الأسرة الجزائري. حيث لم يُبيّن المشرع الجزائري ضمن أحكام الميراث كيفية توريثه خلافا لعلماء الفرائض الذين تصدوا لهذا الموضوع الذي أفرز الكثير من الاشكالات النظرية والعملية بالرغم من اختلافهم حول كيفية توريثه ومن معه من الورثة، على اعتبار أن تقدير فريضة الخنثى المشكل تخضع لحل مسألته كذكر وحلها كأنثى على أن يتم تحديد نصيبه بعد ذلك إما من خلال متوسط النصيبين أو معاملته بالأضر واليقين، هو أو من معه من الورثة. وفي هذا الاطار تظهر اشكالية اعتماد الرأي الفقهي الذي يستند عليه في توريث الخنثى المشكل على اعتبار أن المشرع الجزائري أحال إلى أحكام الشريعة الاسلامية في المسائل التي لم ينص عليها قانون الأسرة.
