المجالات المحمية في ظل التشريع الجزائري

Abstract

حظيت المجالات المحمية في التشريع الجزائري بحماية قانونية متميزة من خلال سن قانون خاص بها (قانون11/02) نظرا لأهميتها العلمية،السياحية ، الترفيهية و الجمالية و لاسيما الايكولوجية بالحفاظ على التنوع البيولوجي بعد أن كانت منظمة بموجب قانون حماية البيئة. حيث عمد المشرع إلى تصنيفها ، تقسيمها حسب أهميتها وحظر العديد من الأنشطة بها و أخضع أخرى للترخيص إلا أن الواقع يؤكد وجود انتهاكات خطيرة لهذه المجالات رغم ما وقعه القانون من جزاء في هذا المجال. Abstract: The protected areas acquired a legal protection in the algerian legislation through the set and enactment of special law wich is (11/02 law ) due to it’s scientific , aesthetic and touristic importance and chiefly the ecological preservation of biodiversity After it was organized under the environmental protection act , where the legislator classified ,divided and prohibited many of the activities in it and subjected others to licensing. However evidence and facts confirm the existence of serious and hazardous violations of these fields despite what has the law established in this field.
