Abstract

انطلاقا من واقع الاجتهاد المعاصر الذي يتّسم -في عمومه- بالضعف الاجتهادي، والاضطراب المنهجي، والتضارب، والفوضى، ومن المفاسد الخطيرة الناجمة عن هذه السّمات، وانطلاقاً من عدم تسليم بعض المشتغلين بالشريعة، والمتعاطين للفتوى؛ بضرورة التزام مرجعية فقهية معينة، في حين يُسلّم بذلك آخرون، ولكن لا يحرّرون مدلولها، ولا يضبطون شروطها، ولا يستهدون بمعالمها؛ جاء هذا البحث ليحاول إبراز أهمية المرجعية الفقهية، وتدقيق مفهومها، وتحرير أقسامها، وتقرير معالم هادية تميّز ما يصلح مرجعا للناس في معرفة أحكام الشرع وتعاليمه ممّا لا يصلح لذلك. ABSTRACT: The majority of contemporary Ijtihad is characterised by methodological inconsistencies and contradictions that often result in dangerous corruptions. Furthermore, it is apparent that both jurists who issue fatwas and those who seek them seem to be indifferent towards the necessity of applying appropriate jurisprudential references when engaging in those activities. Meanwhile, jurists who do rely on an appropriate reference, often do so without adequately outlining nuances, conditions and guiding landmarks. Based on the above observations, this research aims to highlight the importance of jurisprudential reference by pinpointing its underlying concepts and categories and establishing a set of parameters that facilitate the distinction between valid and invalid rulings.
