الاجتهاد المقاصدي في نوازل الوقف : الوقف العلمي نموذجا

Abstract

لا يكاد يخفى على أحد ما للوقف الإسلامي من أدوار حضارية كبرى في مجالات عدة ومختلفة، لا سيما ما يتعلق بالمؤسسة الدعوية المتمثلة في الجوامع والتكايا والزوايا أو ما يتعلق بالمؤسسة العلمية المتمثلة في العناية بالمدارس والخِزانات العلمية والمكتبات ورعاية العلم وطلبته أو غيرها من المؤسسات الوقفية المختلفة التي تشمل أنواع احتياجات المجتمع الإسلامي. ونتيجة لذلك التقدير الإسلامي الكبير للوقف، فقد جاءت نتائجه وآثاره الخيرة الاقتصادية والاجتماعية والثقافية والسياسية على المستوى نفسه من المكانة والأهمية، التي كان لها الدور الفعّال في عملية التطور والنمو الاقتصادي والاجتماعي في مختلف العصور الإسلامية. وقد حاولت في هذه الورقة أن أعرض لجملة من المظاهر والنماذج الوقفية على المؤسسة العلمية، أو ما يمكن تسميته بالوقف العلمي، ومدى صلة أحكامه ونوازله بمقاصد الشريعة الإسلامية ومقاصد الواقفين، خصوصاً إذا علمنا أن قضايا الوقف كثيرة ونوازله متعددة تحتاج إلى فقه واجتهاد يتناغم مع مقاصد الشريعة. وعليه ووفقا لما سبق حاولت جمع شتات هذا الموضوع في تمهيد ومبحثين. عرَّفت في التمهيد بالمفاهيم المتعلقة بالبحث، وتناولت في المبحث الأول أثر اعتبار المقاصد الشرعية في الوقف؛ والمتمثلة في جملة من النوازل والفتاوى المتعلقة بالوقف العلمي، وعرضت في المبحث الثاني لتحليل بعض الحجج الوقفية والمتعلقة أيضا بالوقف العلمي ومدى مراعاتها للمقاصد العامة للشريعة. وانتهيت في ختام البحث إلى مجموعة من النتائج، سائلا الله تعالى التوفيق والسداد. Abstract: Ijtihad Makassedi in the cataclysms of wakf and ways to revive it - Scientific wakf as an example- Islamic Waqf has a major cultural role in several areas, particularly in relation to the institution of daawa like mosques or with respect to the scientific institutions and, libraries, or any institution which take care of Islamic science students or the types of needs of the Muslim community. As a result, of the great Islamic appreciation of wakf, were the consequences and effects of the economic, social, cultural and political benevolent at the same level of importance, which had an active role in the process of economic and social development in various Islamic eras. I have tried in this paper to introduce a series of Wakfmodels to scientific institution, or what might be called scientific Wakf , and the relevance of its provisions and cataclysms with the purposes of Islamic law, especially if we know that many Endowment issues and multiple Wakf research need to be in harmony with the general purposes of Islam. Thus, I tried to collect the pieces in this issue and pave them in an introduction and two.sections. I dealt in the introduction with the notions of the research. In the first section I studied the impact of the general purposes of Islam on Wakf. In the second section I analyzed some of the arguments relating to Wakfand the extent of its observance of the general purposes of Islam. I finished at the end With a set of search results, praying to God to help and guide all of us.
