إطلاقات الجواز عند الفقهاء

Abstract

يستخدم الفقهاء مصطلحات فقهية وأصولية للدلالة على الحكم الشرعي، وبعض تلك المصطلحات لها معان أصلية مشهورة، ولها معان أخرى فرعية يمكن الوقوف عليها من خلال الفروع الفقهية، ومن أبرز تلك المصطلحات التي يكثر استعمالها في الفقه مصطلح الجواز الذي يدل في الأصل على استواء طرفي الفعل من حيث الإقدام عليه أو ترْكه، إلا أن للجائز معانٍ أخرى غير المعنى الأصلي، ويهدف البحث إلى الكشف عن الاستعمالات المتعددة للجواز من خلال إيراد بعض الفروع الفقهية، وبيان القرائن التي يستند إليها الفقيه في تحديد المراد. Jurisprudents use jurisprudential and fundamental terms to indicate the Islamic ruling, some of those terms have famous original meanings and have other sub-meanings which can be seen through the jurisprudential branches. One of the most prominent and frequently used terms in jurisprudence is the term permissibility which originally refers to the equality in between doing and leaving the action, but it has other meanings beside the original one. The research aims to reveal the other numerous uses of permissibility by stating some jurisprudential branches and showing the clues that the jurisprudent based on to determine the meaning of permissibility.
