الإحتلال الحربي في ظل القانون الدولي العام

Abstract

إذا كانت الحرب قديما وسيلة مشروعة في القانون الدولي وبالتبعية لا تحكمها أي ضوابط قانونية، فإن هدا الفعل أصبح في ظل قواعد القانون الدولي الحديث تصرفا غير مقبول لحل النزاعات الدولية، لتناقض دلك مع أحكام ميثاق الأمم المتحدة، وهو نفس الحكم ينطبق عن الاحتلال الحربي من حيث المبدأ، لكنه وفي المقابل فإنه في حالة حدوث هدا الاحتلال فان المجتمع الدولي أقر مجموعة من القواعد القانونية تنظم هدا التصرف من خلال العديد من الصكوك الدولية، وهو الأمر الذي يحتم علينا ومن باب أولى توضيح كل ما يتعلق بهذا الاحتلال الحربي استنادا لما اشتملته قواعد القانون الدولي عامة والإنساني بخاصة دون نسيان إسهامات الفقه في هدا المجال حتى يمكن تميزه عن صور الاحتلال الأخرى . Abstract: Military occupation Under public international law If the war was in the past considered as a legitimate means by the international law, and therefore, it was not subject to any legal control, this act is considered today, according to the regulations of the current international law, unacceptable for resolving international conflicts due to its contradiction with the provisions of the UN Charter. The same applies to the military occupation by principle, however, in the case of such an occupation; the international community has issued a set of legal rules that control this act through several international instruments. Therefore, we have to clarify all matters relating to this act, by referring to the content of the rules of the international law in general and the humanitarian law in particular, not to mention the contributions of jurisprudence in this matter so that we can distinguish it from other occupations.
