المقاصد الأخلاقية وتجلياتها في المنظومة الأصولية والفقهية

Abstract

يهدف البحث إلى استجلاء مصطلح الأخلاق لغة واصطلاحاً والتنقيب في ثنايا المفهوم عند العلماء عموما وعند علماء الفقه والأصول خصوصا، ليعالج إشكالية إغفال العلماء لتأصيل علم الأخلاق واهتمامهم فقط بالجانب الفقهي تأصيلا وتقعيدا وتفريعا، وكذا تصنيفهم للأخلاق في باب التحسيني مما يوحي بأنها كماليات لا ضروريات، بالرغم من أن إتمام مكارم الأخلاق غاية ومقصد الرسالة المحمدية بل ومقصد الرسالات السماوية السابقة. كما يسعى البحث لتحديد العلاقة وإبراز التشابك الخصواقع بين مبحث الأخلاق وبين مختلف مباحث الشريعة الإسلامية كالفقه وأصول الفقه ومقاصد الشريعة، لنصل من ثم إلى تحديد المقاصد الأخلاقية وبيان مراتبها المختلفة الضرورية والحاجية والتحسينية. Abstract: This research endeavors to explain, and prospect the ethical terminology‘s definition amongst scholars generally, and particularly those of jurisprudence and fundamentals in order to treat the problematic of ignoring the rooting of ethics by scholars and solely putting their interest on the jurisprudence side, as well as considering ethics as embellishment, which leads us to think of it as an accessory not a necessity, despite the important place given to the purpose and finality of ethics in the message of the prophet Mohamed and to all the previous divine messages as well, then fix the relation and highlight the interlacement between the study of ethics and the different Islamic law studies like jurisprudence, the principles of Fiqh and charia’s finalities, to arrive at fixing ethical finalities and stating its different ranks: obligatory, needed and optimizations purposes.
