Abstract

إنّ من أهمّ فروع القانون الخاص قانون الأسرة، أو كما يسمّى في تونس مجلة الأحوال الشخصية الذي لاقى اهتماما كبيرا في العقود الأخيرة بالدراسة والتحليل والتحقيق والمقارنة، ومرجع ذلك أساسا إلى مكانة الأسرة في المجتمعات من جهة، وتغير الواقع الاجتماعي لها، الذي فرض تعديلات جديدة لبعض مواد قانونها من جهة أخرى. إنّ مدار الأسرة في القانون التونسي والفقه الإسلامي هو عقد الزواج، الذي لابدّ له من توفر أركان وشروط لينعقد صحيحا وينتج آثاره، غير أنه قد تختلّ هذه الأركان أو تتخلف فيتغير وصف العقد إلى ما يقابل الصحة وهو البطلان، فماذا يقصد ببطلان عقد الزواج في مجلة الحوال الشخصية؟ وما مدى توافقه أو اختلافه مع الفقه؟ وماهي صوره وآثاره مقارنة بالفقه الإسلامي؟ Abstract: One of the most important branches of private law is familly law; or as called in Tunisia personal status magazine, wish has received considerable attention in recent decades to study, analyze, investigate and compare, This is because of the status of the family in societies on the one hand , And changing their social reality Which imposed new amendments to some articles of its law on the other.
