الترجيح بشهادة الأصول دراسة تطبيقية على كتاب "الذب عن مذهب مالك" لابن أبي زيد القيرواني

Abstract

في هذه الورقة العلمية إظهار للجهد العظيم الذي بذله ابن أبي زيد القيرواني في الدفاع عن مذهب مالك، وذلك وفق ما تقرر فيه من أصول كلية، بحيث لا يمكن للناظر في مدونات المذهب الـموروثة أن يدرك مآخذ رواياته وأقواله الـمختلفة، ولا أن يفهم تفريعاته المستخرجة إلا من خلالـها، والغفلة عنها -لا مـحالة- موقع في اللبس والاشتباه. وقد خلص البحث إلى إنّ الفهم الشمولي للشريعة يجعلها كالصورة الواحدة بحسب ما ثبت من كلياتها وجزئياتها الـمترتبة عليها، وينفي عنها كل خُـلْفٍ أو تَـضادٍ. ABSTRACT: This article highlights the great effort made by Ibn Abi Zayd al-Qayrawani in defense of Imam Malik's school, in accord with its established holistic fundamentals, so the readers in inherited doctrine books can not realize the evidences of different opinions and sayings, and doesn't understand it except through it, and Overlooking of that will inevitably induce confusion and suspicion. The research concluded that the holistic understanding of Sharia makes it a single image based on what has been proven in its colleges and partials, and denies it any contradiction.
