Abstract

لا تتوقف المسؤولية في جنح الصحافة عند طرف معين، أو فاعل واحد يمكن أن يعرفه القانون ويحدد له العقوبات الملائمة وذلك بسبب تداخل الأدوار وكثرة المتدخلين في العملية الإعلامية، كما أن الجنحة الصحفية لها بعض الاستثناءات والخصوصيات تجعلها تختلف عن بقية جنح الحق العام، ولا تخضع لنفس طرق الإثبات والتكييف، التي تخضع لها بقية الجنح والجرائم، فالمخالفات التي ترتكب عبر الصحافة أو بواسطتها، تستوجب معالجة خاصة تختلف التشريعات في تصنيف وترتيب الضمانات القانونية التي تستوعب هذه الخصوصية وتحمي بها الصحفي من كل أنواع التعسف وتكفل في نفس الوقت حرية الرأي وحرية التعبير، ومن أهم الخطوات في ذلك مسالة تحريك الدعوى، التي تعتبر أساسية سواء بالنسبة لحماية الصحفي وهي موضوع المقارنة في هذه الورقة البحثية بين التشريع الجزائري والتشريع الفرنسي.
