مصادرة مبلغ التأمين وتأثيره على تنفيذ العقود الإدارية في الجزائر

Abstract

تتمتع الإدارة العامة أثناء تنفيذها لعقودها الإدارية ،بمجموعة من الامتيازات والسلطات والضمانات ،التي نستعملها من أجل السير الحسن والمستمر لمرافقها العامة. إذ تستعمل امتيازاتها في توقيع جزاءات مختلفة ،على المتعاقد المقصر أو المهمل في تنفيذ العقد بإرادتها المنفردة ،ودون اللجوء إلى القضاء .ومن أبرز هذه الجزاءات وأخطرها وهي الجزاءات المالية ،فقد تفرض الإدارة غرامات تأخيرية أو تعويضات أو مصادرة لمبلغ التأمينات، ويعد هذا الأخير من أبرز الضمانات التي تستعملها الإدارة للتنفيذ الحسن والأمثل لعقودها الإدارية،وهو ما تضمنته مختلف التشريعات ،ومن بينها النصوص المتعلقة بتنظيم الصفقات العمومية في الجزائر. Abstract: In carrying out its administrative contracts ,the public administration shall enjoy a range of privileges ,powers and guarantees which we use for the good and continuous conduct of its public facilities. Its privileges are used to impose different sanctions on a contractor who is negligent or negligent in carrying out the contract unilaterally and without resorting to justice. The most prominent and most serious of these sanctions, namely, financial sanctions, may be imposed by the administration on delay fines, compensation or forfeiture of the amount of insurance, which is the latter One of the most important guarantees used by the administration is the good and optimal implementation of its administrative contracts, which are contained in various legislations, including those relating to the regulation of public transactions in Algeria.
