التخريج على القواعد عند المالكية من خلال نوازل المعيار المعرب للونشريسي

Abstract

يتناول هذا البحث موضوع التخريج على قواعد الإمام من حيث تعريف هذا العلم وبيان حكمه واستعمالاته وتطبيقاته، وذلك قصد إثراء علم التخريج تأصيلا وتنزيلا، وذلك من خلال أعظم كتاب حوى النوازل عند المالكية وهو المعيار المعرب للونشريسي، وقد كان لهذا البحث جانبان نظري و تطبيقي، النظري عُني بالتنظير للتخريج على القواعد والتطبيقي عني بذكر أمثلة من المعيار المعرب ودراستها، وقد استخدمت المنهج الاستقرائي لاستقراء المسائل المخرجة على القواعد في المعيار و التحليلي لدراستها، وقد توصلت إلى أن المالكية عنوا كثيرا بالتخريج على قواعد الإمام مالك، وعدوه مسلكا ثانيا من مسالك التخريج بعد التخريج على النصوص، والأمثلة الشاهدة من فتاواهم لا تعد كثرة This research deals with the topic of graduation on the rules of the imam in terms of defining this science, explaining his rule, its uses and its applications, with the aim of enriching the science of graduation in its original form and download, and that is through the greatest book of the events of the Malikis, which is the Arab standard for Al-Wanchrisi. I mean theorizing for graduation on grammar and application on my behalf by citing examples of the Arabized criterion and studying them, and I have used the inductive approach to extrapolate the issues produced on the rules in the standard and analytical to study them.
