آثار الاعمال الطبية على عملية التلقيح الاصطناعي بين الفقه الإسلامي والتشريع

Abstract

توصل العلماء إلى أساليب فنية طبية تساعد الفرد على ممارسة حقه في الإنجاب إذا كان يعاني من العقم أو غيره من الحالات الصحية التي تحول دون التمكن من ذلك بالطرق الطبيعية. فظهرت فكرة التلقيح الاصطناعي التي لم تعد قاصرة على طريقة دون أخرى بل تعددت صور التلقيح وتنوعت أشكاله وأساليبه. وهذه الممارسات الحديثة وان كانت طبية ومفيدة، إلا أنها تثير بعض المشاكل الشرعية والقانونية الخاصة بمخالفة القواعد الأساسية للتلقيح الاصطناعي، والمتمثلة في قيام هذه العملية حال وجود الرابطة الزوجية وان يتم استنفاذ كافة وسائل معالجة العقم فقط. وأي انتفاء لأحد أركانها و قواعدها أو عدم مراعاة الطبيب القائم بهذه العملية لأصول مهنته يرتب عليه مسؤولية مدنية كانت أو جنائية. Scientists have come up with medical technical methods that help an individual to exercise hi right of reproduction if he suffers from infertility or other health conditions that prevent it from being able to do so by natural methods so the idea of artificial insemination appeared ,which is no longer limited to one method without another. These modern practices, even if they are medical and useful, raise some legal problems related to the violation of the basic rules of artificial insemination, which is that this process take place in the event of the marital bond and that all means of treating infertility are exhausted only. Due to the origins of his profession, he is subject to civil or criminal liability.
