Abstract

إن العقد الطبي في الجراحة التجميلية لا يتعلق بمرض معين، بل بعلاج عيب أو تعديل مظهر عضو من الجسم، فلا يتطلب الاستعجال ويكون الشخص في وضعية طبيعية تجعله يبدي موافقته على إجراء العملية، خصوصا إذا كانت الجراحة تجميلية غير علاجية. إن جراح التجميل يكون التزامه مشددا في جراحة التجميل غير العلاجية، ويكون مسؤولا مسؤولية عقدية إذا توافرت أركانها ولم يتمكن من دفع المسؤولية. لقد شهدت جراحة التجميل في السنوات الأخيرة تطورا كبيرا في كل الدول، ومنها العربية إلا أنها لم تحظ بالاهتمام في القانون الجزائري، على الرغم من الأعداد الهائلة التي خضعت لجراحة التجميل.
