أليات التحكم في تسيير تفويضات المرافق العامة - دراسة على ضوء المرسوم التنفيذي رقم 199/18 المتضمن تفويضات المرافق العامة -

Abstract

يسعى المشرع الجزائري باللجوء إلى التحكم في نمط تسيير تفويضات المرافق العامة لضمان ترقية أداء الخدمات العمومية بإشراك منتفعي المرفق العام في الرقابة و التقييم. كما يعتبر نظام الرقابة على تفويضات المرفق العام وسيرها وآليات فض النزاعات بالطرق الودية بين أطراف اتفاقية التفويض من بين طرق التحكم في سير تفويض المرفق العام، وهذا لا يكون إلا بالتأكد من الاعتماد على الشروط المنصوص عليها في هذه الاتفاقية عند اتخاذ القرارات، وأيضا الخضوع للأنظمة والقوانين والإجراءات المقررة قانونا، منع حدوث الأخطاء والانحرافات، واكتشاف ما يقع منها أولا بأول ثم اتخاذ الإجراءات التصحيحية اللازمة لمعالجتها ومنع تكرارها. The Algerian legislator aims to make use of the control of the mode of the management of the delegations of the public establishments to guarantee the improvement of the executions of the public services while involving the beneficiaries of the public establishments to the operation of the monitoring and the evaluation. The system of the supervision of the delegations of the public establishments, their management and the mechanisms of the settlement of the friendly disputes between the parts of the convention of the delegation, is considered one of the methods of control and the management of the delegations of the public institutions. This will take place only on the basis of the conditions mentioned in the agreement when making the decisions, and also after the submission to the procedures prescribed by the law, prohibiting all kinds of errors or deviations and discovering any deviations as necessary, and then adopt the corrective procedures necessary to remedy them and avoid their reproduction.
