النظام القانوني للإرتفاقات الجوية و أثرها على الملكية العقارية

Abstract

إن موضوع الارتفاقات الجوية يعتبر من المواضيع ذات الأهمية البالغة ، نظرا لتنامي أهمية قطاع الطيران في الدولة التي يقع عليها ضمان سلامة النقل الجوي ، لذلك فإن إيجاد فضاء مهيأ يستوعب نشاط الطيران المدني يقتضي تقييد حق الملكية لصالح المطارات، و ذلك عن طريق فرض ارتفاقات جوية على مستوى الأملاك العقارية المجاورة للمطارات ، هذه الدراسة تعالج الجانب القانوني لفرض هذه الارتفاقات و آليات إنشاءها و كذا نطاق و مدى القيود المترتبة عنها على ضوء الأحكام القانونية المتعلقة بحق الملكية، ومختلف النصوص القانونية التي تنظم مجال الطيران المدني . Abstract: The subject of air easements is considered one of most important topics, seeing that importance of the aviation sector in the country in which the safety of air transport warranty, Therefore , creating a suitable space that accommodates civil aviation activity requires restricting the right of ownership for the benefit of airports by imposing air-easements real estate properties adjacent to airports, this study deals with the legal aspect of imposing these agreements and the mechanism for their establishment, as well as the scope and extent of restrictions resulting there from in the light of legal provisions related to the right of ownership and various legal texts that regulate the field of civil aviation.
