حالة الطوارئ الصحية وأثرها على حرية الرأي والتعبير

Abstract

ظهر في أواخر سنة 2019 فيروس قاتل اصطلح العلماء على تسميته بكورونا (covid19) بمدينة يوهان الصينية، ثم اجتاح العالم بأسره بطريقة سريعة وقاتلة، مما أثر على صحة وحياة الأفراد واقتصاديات الدول وحقوقهم وحرياتهم العامة، وهذا ما جعل منظمة الصحة العالمية تعلن حالة الطوارئ الصحية، والجزائر كغيرها من الدول التي أصابها الفيروس اتخذت العديد من التدابير والإجراءات الخاصة لمجابهته، فما مدى فعالية هذه الإجراءات في التصدي لهذه الجائحة وما مدى توافقها ومبادئ حقوق الإنسان وحرياته العامة؟ وهل كان لهذه الإجراءات أثر على حرية الرأي والتعبير؟ وتهدف هذه الورقة البحثية إلى الإجابة عن هذه الإشكالية من خلال المحاور الآتية: المبحث الأول: مفهوم حالة الطوارئ الصحية بسبب جائحة كورونا والمبحث الثاني: أثر حالة الطوارئ الصحية بسبب جائحة كورونا على حرية الرأي والتعبير. وقد توصلت هذه الدراسة إلى مجموعة من النتائج أهمها أن حالة الطوارئ الصحية التي سببها فيروس كورونا قد أثرت وبشكل سلبي على حرية الرأي والتعبير، ويظهر ذلك جليا من خلال الانتهاكات الجسيمة التي تعرض لها الصحفيون عالميا سواء ميدانيا أو في الفضاء الإلكتروني. At the end of 2019, a deadly virus appeared, which scientists called Corona in the Chinese city of Yuhan, and then invaded the entire world in a rapid and fatal way, which affected the health and lives of individuals and the economies of countries and their rights and public freedoms, and this is what made the World Health Organization declare a state of health emergency, Algeria, like other countries affected by the virus, has taken many special measures to confront it, how effective are these measures in addressing this pandemic, and how compatible are they with the principles of human rights and public freedom? Did these measures affect freedom of opinion and expression? This research paper aims to answer this problem through the following axes: First, the concept of a state of health emergency due to the Corona pandemic, Secondly and finally, the impact of the state of health emergency due the Corona pandemic on freedom of opinion and expression. This study reached a set of results, the most important of which is that the health emergency caused by Corona virus has negatively affected freedom of opinion and expression, this is evident in the grave violations that journalists have been subjected to globally, whether on the ground or in the blue space.
