الاستصحاب بين التأصيل والتعليل عند الأصوليين

Abstract

يُعد الاستصحاب من أهم الأدلة الشرعية التي اعتمد عليها الأصوليون في استنباط الأحكام الش رعية، خاصة في الحالات التي يتعذر فيها الوصول إلى دليل قطعي، يهدف البحث على دراسة آراء الأصوليين في هذا الشأن، وتحديد مدى اختلافهم واتفاقهم حول مكانة الاستصحاب في عملية الاستنباط الفقهي . كما يتناول البحث مفهوم الاستصحاب وأنواعه المختلفة، وبيان اختلاف الأصوليين في حجيته، وهل يعد الاستصحاب دليالا شرعياا .مستقالا يستند إلى تعليل عقلي، أم أنه ليس دليلاا مستقلاا، وإنما هو مجرد قاعدة عملية تنطلق من الأصل وتستند إلى التأصيل"Istishab is considered one of the most important legal proofs that the Usulis relied on in deriving Islamic legal rulings, especially in cases where a definitive proof is unattainable. This research aims to study the opinions of the Usulis on this matter and determine the extent of their agreement and disagreement regarding the status of istishab in the process of legal inference. The research also addresses the concept of istishab, its various types, and the differences among the Usulis regarding its validity. It explores whether istishab is an independent legal proof based on rational reasoning or merely a practical rule that stems from the original principle and is based on establishment."
