ضوابط التفتيش في الجرائم الإلكترونية

Abstract

من أهداف التفتيش الإلكتروني الوصول إلى الأدلة المعلوماتية المتمثلة في مجموع البيانات المخزنة على الوسائط وأنظمة الحواسيب وكل تلك البيانات الموجودة في العالم الافتراضي، لكن يمتاز التفتيش الإلكتروني بجملة من الخصائص والضوابط التي تميزه عن التفتيش التقليدي والتي تعقد من عملية البحث عن الدليل الإلكتروني، منها ما يتعلق بطبيعة تلك الجرائم ومنها ما يتعلق بأطراف الجريمة وطبيعة مرتكبيها ومنها ما يتعلق بمسرح الجريمة باعتباره بيئة افتراضية. ويهدف هذا البحث إلى إبراز هذه الخصائص والضوابط التي يمتاز بها التفتيش الإلكتروني دون غيره سواء تلك الضوابط والشروط المتعلقة بالناحية الموضوعية أو الشكلية أو تلك الضوابط التي يتطلبها التفتيش الإلكتروني عند التنفيذ من حجز للمعطيات الإلكترونية أو في حال استحالة حجزها فرض الحماية القانونية عليها. One of the main goals of electronic inspection is to obtain digital evidence, which encompasses all data stored on media and computer systems, as well as any data present in the virtual world. However, electronic inspection differs from traditional inspection in its unique set of characteristics and controls, making the process of searching for electronic evidence more complex. These include the nature of the crimes being investigated, the parties involved, the characteristics of the perpetrators, and the virtual crime scene. The aim of this research is to emphasize the specific characteristics and controls that distinguish electronic inspection from other types of inspections. These controls relate to both objective and formal aspects, including the procedures required for electronic data seizure or the imposition of legal protection on the data in cases where seizure is not possible.
