المستوى المعيشي اللائق بين الحق والالتزا م درا سة في القانون الدولي

Abstract

إن الحق في مستوى معيشي لائق حق مركب يتكون أساسا من الحق في الغذاء الكافي، الحق في الماء والصرف الصحي، الحق في السكن، الحق في الخدمات الصحية، والحق في الحماية الاجتماعية من خلاله تتدخل الدولة لتحقيق عدالة اجتماعية بإعادة توزيع الثروة، وتحقيق تضامن اجتماعي بين الأفراد. فتقع عليها التزامات فورية، بعدم التمييز خلال تطبيقه، وعدم اتخاذ اجراءات تراجعية تلغي أو تخفض استفادة أفراد أو جماعات منه، كما ولارتباطه الوثيق بالموارد المتاحة في الدولة، فيخضع لمبدإ الإعمال التدريجي من خلال خطط واستراتيجيات ممتدة على فترات زمنية معقولة تسمح بأحسن استعمال للموارد المتاحة مع منح الأولوية للفئات الأكثر حرمانا وتهميشا The right to an adequate standard of living is a right composed mainly of the right to adequate food, the right to water and sanitation, the right to housing, the right to health services and social protection. Through this right, the State intervenes to achieve social justice by redistributing wealth and achieving social solidarity between individuals. the State has immediate obligations, not to discriminate, and not to take retrograde measures which cancel or diminish the benefit of individuals or groups. Since it is linked to the resources available in the State, it is therefore subject to the principle of progressive realization, through plans and strategies covering reasonable time periods that allow the best use of available resources, while prioritizing the most disadvantaged and marginalized groups.
