التكريس الجنائي للحماية الدستورية للروابط الأسرية

Abstract

نظرا لأهمية الأسرة وتفعيلا لدورها الفعال في تطوير المجتمع وإستمراريته، حرص الدستور الجزائري على حماية بعض الروابط الأسرية بنوع من الخصوصية، إذ تم إيكال مهمة تجسيد هذه المهمة واقعيا إلى للمشرع الجنائي، وهي النقطة التي اثارت لدينا فضولا بالبحث فيها من خلال طرح تساءل حول كيفيات تجسيد المشرع الجنائي لهذا الواجب الدستوري الملقى على عاتقه متبعين في ذلك خطة ثنائية نصبوا من خلالها إلى تحقيق هدفين، أولهما تحديد آليات اسناد الستور مهمة صيانة هذه الروابط إلى المشرع العقابي وهو ما تم في الجزء الأول من الدراسة، وثانيهما دراسات مدى تجاوب المشرع الجنائي في كفالته للروابط الأسرية وهو ما تم في الجزء الثاني، لنصل في الأخير إلى أن المشرع سعى إلى حماية هذه الروابط من خلال بسط الحماية الجزائية على مكونات الأسرة Given the importance of the family and its active role in the development and continuity of society, the Algerian Constitution has taken care to afford certain family, relationships a form of special protection. This responsibility was entrusted to the criminal legislator for practical implementation. This point sparked our curiosity and prompted us to investigate how the criminal legislator fulfills this constitutional duty entrusted to them We adopted a twofold approach aimed at achieving two objectives: first, to identify the mechanisms by which the Constitution entrusts the criminal legislator with the task of preserving family relationships, as discussed in the first part of the study; and second, to examine the extent to which the criminal legislator has responded to this responsibility in protecting family ties, as explored in the second part. Our conclusion is that the legislator has indeed sought to protect these relationships by extending criminal protection to various components of the family
