Abstract

تبحث هذه الورقات؛ مسألة من المسائل الفقهية، التي اثارت العديد من التساؤلات، ودارت حولها جملة من المناقشات، خاصة في هذه الأوقات؛ وهي : " حكم الصلاة على الجنازة في المسجد ". فجاءت هذه الدراسة لتُبيِّن أقوال الفقهاء في القديم والحديث فيها، وتحلي أبرز الأدلة النقلية والعقلية التي عَوَّلَ كل فريق منهم عليها، وتزير قائمة الاعتراضات وسلسلة المدافعات التي رد بها كل فريق على الآخر، للخلوص إلى القول الراجح في المسألة، بحسب ما يُفضي إليه الحديث والأثر، ويمليه جانب التعليل والنظر. وتتنزل هذه المحاولة ضمن طرح جديد، وسعي أكيد، بمنهج سعيد؛ في الدعوة إلى انصاف المذاهب الفقهية المتبوعة، والمساهمة الفعالة في التخفيف من التعصب المذموم لاجتهادات الأشخاص وتقديس أرائهم، كما تتغيا هذه السطور صناعة العقل الفقهي المعاصر، وتكوين الملكة الفقهية الرزينة التي لا تَتَحَقَّقُ إِلَّا من خلال استشراف أقوال الأئمة الأكابر، وإشباع النظر بنصوصهم، وطريقة فهمهم للأدلة القائمة على القواعد والأصول.
