الأحكام الشرعية للمعاملات المالية في تكنولوجيا الميتافيرس

Abstract

تناولت هذه الدراسة قضية المعاملات المالية في البيئة الافتراضية "الميتافيرس" ومدى تحقق الضوابط الشرعية للعقود فيها باستخدام تقنية البلوكتشين بعيدا عن وساطة الاقتصاد المركزي، وكان الإشكال يتعلق بمدى الأمان في التصرفات المالية بالنسبة للمتعاقدين في عالم الميتافيرس خاصة في ضوء الفراغ في التشريع الفقهي والقانوني الحاكم لأقضية هذه النازلة، كما تم بحث قضايا المخاطرة والغرر وأحكام التصرفات العقدية من معاوضات ومشاركات واستثمار اعتمادا على تقنية البلوكشين في هذا العالم الافتراضي، ووصلنا إلى أن التعامل في الميتافيرس يتم على أصول مشفرة غير مادية تحتاج إلى تشريعات عقدية خاصة، تدرأ الغرر والمخاطرة، وإن القول بمشروعية التعامل بتقنية البلوكشين لما لها من خصائص الأمان، وبالنظر لتحقق شروط مجلس العقد الصحيح في طريقة بنائها وأدائها، يترتب عليه القول بشرعية التعامل المالي في الميتافيرس بيعا وشراء واستثمارا بضوابطه الشرعية In the hypothetical "Metaverse" environment and the extent to which legal controls of contracts are achieved using blockchain technology away from the mediation of the central economy.
