Abstract

تعتبر الأملاك الوقفية باب من أبواب الفقه الإسلامي وما فيها من نصوص شرعية وتفصيلات فقهاء المذاهب الإسلامية، وهي في الحد ذاته باب أيضا من أبواب التشريع الجزائري من خلال النصوص القانونية والتنظيمية التي خصها بها مراعيا في ذلك أحكام الشريعة الإسلامية، فهي نظام مؤسساتي قائم بحد ذاته، تتمتع بالشخصية المعنوية، لذا وجب إخضاع هذا النظام المؤسساتي إلى حماية خاصة تضمن حصانته، فضمان بقاء الملك الوقفي واستمراره ودوافعه مرتبط بالتصرفات التي تجلب المصلحة وتدفع المفسدة وفق أحكام الشريعة الإسلامية والصياغة القانونية التي تقنن تلك الأحكام Endowment properties are considered one of the chapters of Islamic jurisprudence and the legal texts that it contains and the details of the jurists of Islamic sects, and in itself it is also one of the chapters of Algerian legislation through the legal and organizational texts that he singled out, taking into account the provisions of Islamic Sharia, as it is an institutional system that exists in itself. It has a legal personality, so this institutional system must be subjected to a special protection that guarantees its immunity. Ensuring the survival and continuity of the endowment king and its motives is linked to behaviors that bring benefit and ward off corruption in accordance with the provisions of Islamic Sharia and the legal formulation that codifies these provisions.
