"الفقه السياسي من إقامة الدولة إلى إقامة الدين " فريد الأنصاري أنموذجا

Abstract

تبسط هذه الدراسة معالم الرؤية الإصلاحية على المستوى السياسي للدكتور فريد الأنصاري - رحمه الله ، و التي تقوم على إعادة الاعتبار للدين كغاية و مقصد شرعي لأجله نزلت الكتب وأرسلت الرسل، تستند إلى أن العمل التجديدي الراشد هو عمل للدين قبل الدولة، وتمكين للقرآن قبل السلطان، معتبرة أن إقامة الدين بعباداته و أخلاقه و أركانه هو مقصد الشريعة الأعظم، وأول خطوة و أهمها في هذا المضمار تكون بترقية المستوى التعبدي وتجويده عند الأفراد والجماعات باعتبار ذلك العنوان الأبرز للدين والتجلي الحقيقي له. يؤكد الأنصاري أن إجابة الحركة الإسلامية على سؤال الدولة الذي اعتبر أخطر الأسئلة و أعز ما يطلب عند أتباعها عموما لم يؤدي فقط إلى تضييق أبواب الإصلاح ومداخله، بل قد يؤدي في النهاية إلى إغلاقها، مشيرا على أن أكبر الأخطاء المنهجية التي وقع فيها منظرو السياسة الشرعية تمثلت في عجزهم عن وضع أمور السياسة في موضعها الصحيح من سلم التشريع الأصولي، والذي يتمثل في الاجتهاد وضمن مجال غير المنصوص عليه. This study discusses the features of the reformist vision at the political level of Dr. Farid Al-Ansari- May God have mercy on him - Which is based on restoring the consideration of religion as an end and a legitimate intention,For him, the books were sent down and the messengers sent, Based on the fact that a rational regenerative act is an act of religion before the state, And empowering the Qur’an before the Sultan, considering that establishing religion with its worship, morals and pillars is the greatest destination of Sharia, and the first and most important step in this regard is to upgrade the level of worship and improve it for individuals and groups; Considering that the most prominent title of religion and its true manifestation. Al-Ansari asserts that the Islamic movement's answer to the state’s question was considered the most great. And the most dear requested by its followers in general did not only narrow the doors of reform and its entrances, Rather, it may eventually lead to its closure, indicating that the biggest systematic errors in which the viewers of legitimate politics have fallen are their inability to put politics matters in the correct position from the staircase of fundamentalist legislation, which is represented in ijtihad and within a field that is not stipulated.
