النظام العام والمواريث

Abstract

تخضع النزاعات ذات العنصر الأجنبي والمتعلقة بالميراث الوصية، وسائر التصرفات التي تنفذ بعد الموت إلى قانون جنسية الهالك أو الموصي أو من صدر منه التصرف وقت الموت طبقا لنص المادة 16 من القانون المدني الجزائري. إلا أن القاضي الوطني يستبعد تطبيق هذا القانون في حالة ما إذا تبين له أنه قانون أجنبي تتعارض أحكامه مع المبادئ والأسس التي يقوم عليها نظام المواريث الوطني المستمد أساسا من أحكام الشريعة الاسلامية Disputes with a foreign element relating to inheritance, will and all other post-mortem acts shall be subject to the law of the nationality of the deceased, the testator or his executor at the time of death in accordance with article 16 of the Algerian Civil Code. However, the national judge does not rule out the application of this law if it is found to be a foreign law whose provisions contradict the principles and foundations on which the system of national inheritance is based mainly on the provisions of Islamic law.
