ظاهرة عمالة الأطفال مابين آليات الشريعة الإسلامية وآليات التشريع الوضعي

Abstract

يتمحور البحث في هذا المقال حول ظاهرة عمالة الأطفال عندما توضع في محك البحث و المعالجة ، فالشريعة الإسلامية في حل المشاكل تركز على الآلية والوسيلة ، من الوازع الديني إلى بعض الممارسات الدينية المتميزة بفاعليتها ، في إطار من الضوابط والأحكام الشرعية ومن خلال ذلك ، طرحت أمثلة عن بعض الشواهد الإسلامية التاريخية باتباع أسلوب التأويل و التحليل والمقارنة بالواقع أما في وقتنا الراهن وقد حدثت تغيرات جذرية عالمية تكنولوجية وتغير مفهوم الدين في أذهان الناس بات من الصعب التحكم إلا من خلال المعالجة القانونية الوضعية، بما في ذلك التشريع الوطني الجزائري والذي يستقي فاعليته من الاتفاقيات الدولية وتوصيات ونصوص المنظمات الحقوقية التي تعاين أوضاع الأطفال في العالم وتكرس نشاطها وفق ذلك The research in this article revolves around the phenomenon of child labor and what resolutions can be implemented in real life, how to apply them? and to what extent? Islamic laws focus on solving problems on the mechanism and the means, from the religious conscience to religious practices which are characterized by their effectiveness, all of that within the framework of sharia laws and regulations. We presented examples of some islamic historical evidence of the method of interpretation,analysis, and comparison reality, but at the present time has undergone a radical global technological changes and the concept of Religion in the minds of the people is difficult to control only through the legal treatment of the situation, including the Algerian national legislation, which draws the effectiveness of international conventions and the recommendations and texts of human rights organizations that monitor the situation of children and devote their activities accordingly .
