Abstract

يعد نظام الوضع تحت المراقبة الالكترونية من البدائل المستحدثة المجابهة مساوئ العقوبات السالبة للحرية قصيرة المدة ، وتبرز أهمية هذا النظام في كونه ن يتيح للمحكوم عليه البقاء في منزله غير أن تحركاته محدودة ومراقبة بواسطة جهاز يشبه الساعة سوار الكتروني - يكن مثبتا في معصمه أو في كاحل قدمه ، بحيث ينطوي هذا النظام على قيود والتزامات يتوجب على الخاضع أن يلتزم بها ، وهذا ما يدفعنا للتساؤل عن أهم الضمانات القانونية المكرسة لحماية الحقوق وحريات وخصوصيات المحكوم عليه ، ومن خلال فحص النظام القانوني لهذا النظام والذي يقتضي لتطبيقه على المحكوم عليه صدور رضا وموافقة هذا الاخير ، خلصت هاته الورقة البحثية بأن هذا النظام يجسد ويحترم الضمانات الدستورية كحرمة الحياة الخاصة ، وحرمة المسكن والسلامة الجسدية ، كما أنه يحقق أغراض وأهداف السياسة العقابية كالردع العام والخاص وتأهيل وإصلاح المحكوم عليه. Placement under electronic surveillance is one of the alternatives developed to deal with the disadvantages of short- term custodial sentences. the advantage of this system is that it allows the convicted person to stay at home .but his movements are limited and monitored by bracelet which is attached to his wrist or ankle .this system includes restrictions and obligations that the subject must respect .which can affect and limit some of his freedoms which leads us to question on the important legal guarantees devoted to the protection of the freedoms and privacy of convicted person .This research paper has concluded that this system respects constitutional guarantees such as the protection of the sanctity of life . and physical safety insofar as it achieves punitive objectives such as public deterrence private and convict rehabilitation.
