مضار الجوار في المحيط الحضري: من المفهوم التقليدي إلى الإشكالات المعاصرة

Abstract

يناقش هذا المقال تطور مفهوم مضار الجوار، بدءًا من جذوره التقليدية في القانون المدني ، وصولاً إلى تعقيداته المعاصرة في المحيط الحضري الحديث ، وتم تسليط الضوء على التحول من التركيز على الأضرار المادية المباشرة (كالضوضاء والتلوث) إلى مواجهة الإشكالات الجديدة الناجمة عن التنمية العمرانية والتكنولوجية (كالتلوث البصري، الإشعاع، ومضار السكن المشترك غير المألوفة في البيئة الحضرية الحديثة، ما يؤدي للقول بضرورة تبني مقاربة قانونية شاملة ووقائية تدمج قواعد القانون العام (التعمير والبيئة) مع القانون الخاص لضمان التوازن بين حق الملكية وحق العيش في بيئة صحية، داعيةً إلى تحديث التشريعات وتفعيل آليات الحكامة الحضرية. This article discusses the evolution of the concept of neighborhood nuisances (Troubles de Voisinage), tracing its roots from traditional Civil Law and tort principles to its contemporary complexities in the modern urban setting. The paper highlights the shift from focusing solely on direct material harms (such as noise and pollution) to addressing new challenges stemming from urban and technological development (such as visual pollution, radiation, and the abnormal nuisances arising from co-owned property in the modern urban environment). Consequently, it advocates for the necessity of adopting a comprehensive and preventive legal approach that integrates principles of Public Law (specifically urban planning and environmental law) with Private Law to ensure a balance between the right to property and the right to a healthy living environment, ultimately calling for legislative updates and the activation of urban governance mechanisms.
