Abstract

عرفت السياسة العقارية في الجزائر تطورات مختلفة نظرا للعوامل التاريخية والسياسية والاقتصادية التي مرت بها، تهدف في مجملها إلى تنظيم وتطهير الوضعية العقارية التي تقوم أساسا على استصدار سندات الملكية، والتي كان على رأسها تبني نظام الشهر العيني وتأسيس السجل العقاري الذي يقوم على المسح العام للأراضي، ونظرا لتأخر هذه العملية سعى المشرع لإيجاد حلول بديلة لتثبيت الملكية تمثلت في معاينة الملكية عن طريق التحقيق العقاري، هذا الإجراء كان موضوع هذه الورقة البحثية التي تهدف للإجابة على الإشكال الآتي : فيما تتجلى فاعلية التحقيق العقاري في دفع عملية التطهير العقاري في الجزائر ؟ وتوصلت هذه الدراسة إلى أن التحقيق العقاري إجراء استثنائي يسهم في استقرار الأوضاع العقارية نسبيا. Algeria has witnessed several developments: historical, political and economic mainly. It aims to organize the estate situation, which is based on the issuance of decrees of ownership. Practically, it adopted a system which is built on the estate registry. The latter requires a survey of lands. Due to the process, the legislator sought to find solutions to confirm estate ownerships.This requires inspecting the property through estate investigations which is the core of this study. This study seeks to answer this question: did the process of inspecting the property contribute to the estate investigation policy in clearing the estate situation in Algeria? Results concluded that estate investigation is an exceptional method that contributes to the stability of real estate conditions.
