الفكر اللساني في علم أصول الفقه: قضايا التركيب ومبادئ الاستدلال الملفوظي

Abstract

يحاول هذا الاستقصاء البحثي رصد المرجعية اللسانية العربية في الدرس الأصولي حيث نهدف من وراءه إلى معاينة الوضع التنظيري في سياقات البحث التي يسلكها علماء أصول الفقه في تأسيس المرجعية اللسانية في استنباط الأحكام الشرعية المؤسسة سلفا حول النص التشريعي في القرآن الكريم والسنة النبوية. وهو الإطار الذي نراه - يشكل أساسا المرجعية الدراسات الألسنية العربية المتعلقة بمباحث تحليل الخطاب، ضمن اشتغالاتها في حقل الدلالة فوق الجملية، ومحاولاتها لتمثيل صور الدلالة الملفوظية والتلفظية. لذا قسمنا هذا الاستقصاء إلى مبحثين بما يشتمل الدلالة الملفوظية والتلفظية منطوقا ومفهوما. وقد انتهينا في المحصلة إلى أن جهود علماء الأصول قد أبانت عن وعي نوعي في مدارسة المعطى اللساني بما يتجاوز أطر التركيبيات والدلاليات إلى مستويات التداوليات. This research inquiry attempts to observe the Arabic linguistic reference in Usool al-Fiqh studies. We aim from it to examine the theoretical situation in the contexts pursued by Usool al-Fiqh scholars in establishing the linguistic reference for deriving Sharia rulings; based on the foundational texts of the Quran and the Sunnah. We see this framework as the foundation for the reference of Arabic linguistic studies relating to discourse analysis within their work in super-sentential semantics and their attempts to represent images of verbal and enunciative signification. Therefore, we divided this inquiry into two discussions, including verbal and enunciative signification, both explicit and implicit. Ultimately, we concluded that the efforts of Usool al-Fiqh scholars have demonstrated qualitative awareness in studying the linguistic data, surpassing the frameworks of syntax and semantics to the levels of pragmatics
