المساواة العادلة والمساواة المطلقة (تأثيرات معاهدة 'سيداو' أنموذجا)

Abstract

استطاعت الحركات العالمية الحديثة التأثير على تشريعات الدول المسلمة من خلال اتفاقيات (سيداو أنموذجا) تحمل معاني فضفاضة القيم كالمساواة والعدل، ساهمت في تردي المجتمعات عوض النهوض بها، نتيجة قيامها على قيم ومبادئ غربية عن القيم والمبادئ الإسلامية. فما الفرق بين المساواة في الإسلام والمساواة التي تتبناها الحركات العالمية الحديثة؟ وما مدى تأثير تلك الاتفاقيات على تشريعات الدول المسلمة من خلال تلك المفاهيم ؟ وتكمن أهمية البحث في تسليطه الضوء على حتمية ضبط المفاهيم، وأثر تطبيق المفاهيم الغربية المساواة أنموذجا) على بعض تشريعات الدول الإسلامية. وخلص الباحث إلى أن الحركات العالمية الحديثة استطاعت التأثير على بعض التشريعات من خلال الاتفاقيات، إلا أنها جاءت دخيلة على المجتمع الجزائري، نتيجة التباين في ضبط المفاهيمModern global movements were able to influence the legislation of Muslim States through agreements holding grandiloquent meanings for values such as equality and jestice which have contributed to deteriorating societies instead of advancing them. This was due to the fact that they carried western values and principles that are totally different fom the Islamic ones. What is the difference between equality in islam and the equality espoused by modern global movements? and what is the extent of the impact of those agreements on the legislation of muslim countries? The importance of the research lies in shedding light on the inevitability of controlling concepts, and the impact of the application of Western concepts (equality as a model) on some legislations of Islamic countries. The researcher concluded that the modern global movements were able to influence some legislations through agreements, but they were foreign to Algerian society, as a result of the discrepancy in controlling concepts.
